Children's Privacy

Modern Optical's websites are not targeted for use by children under the age of 13. Modern Optical does not knowingly collect personal information from children in connection with the features of our websites without the consent of a parent or guardian. Modern Optical requests that all visitors under 13 to our websites to not disclose or provide any personally identifiable information. Upon notification that a child under 13 has provided us with personally identifiable information, we will delete the child's personally identifiable information from our records.

Modern Optical is based in the United States, and our website is hosted here. If you are visiting our website from another country, the laws governing our website’s collection and use of personal information may be different from the laws of your country. If you decide to visit our website, or share your personal information with Modern Optical, you are agreeing to be governed by the laws of the United States, and you are expressly consenting to the transfer of your data to the United States.

In particular, please note that neither our website, nor the products and services we offer on our website, nor any other activities we carry out as set out in this privacy policy are aimed at individuals based in the United Kingdom or any jurisdiction within the European Economic Area (“EEA”). Accordingly, if you are based in the United Kingdom or any jurisdiction within the EEA, and wish to connect with, or purchase products or services from, Modern Optical, by continuing to complete order forms and online purchasers, you are expressly granting informed consent to the sharing of such minimal personal information as may be required to complete the transaction. Shine the Light

In addition to the information provided in this Privacy Policy, under California's "Shine the Light" law, California residents who provide "personally identifiable information" (as defined in the California law) in obtaining products or services for personal, family, or household use are entitled to request and obtain from us, once a calendar year, information about the personally identifiable information we shared, if any, with other businesses for marketing uses. If applicable, this information would include the categories of personally identifiable information and the names and addresses of those businesses with which we shared such personally identifiable information for the immediately prior calendar year. Do-Not-Track

Some browsers give individuals the ability to communicate that they wish not to be tracked while browsing on the Internet. California law requires that we disclose to users how we treat do-not-track requests. The Internet industry has not yet agreed on a definition of what “Do Not Track” means, how compliance with “Do Not Track” would be measured or evaluated, or a common approach to responding to a “Do Not Track” signal. Due to the lack of guidance, we have not yet developed features that would recognize or respond to browser-initiated Do Not Track signals in response to California law. In the meantime, there are technical means to prevent some of the tracking, if any.

Rights of EU Data Subjects

Scope. This section applies if you are an individual located in the European Union or European Economic Area (collectively, "EU") ("EU Data Subject").

Data Controller. Modern Optical is the data controller for the processing of your personally identifiable information.

Legal Basis for the Processing. The grounds on which we rely to process personally identifiable information, according to the purposes identified, include the following:

• Rights in relation to automated decision-making and profiling: You have the right to be free from decisions based solely on automated processing of your personally identifiable information including profiling, that affect you, unless such processing is necessary for entering into, or the performance of, a contract between you and us or you provide your explicit consent to such processing.
• Right to lodge a complaint with the data protection authority: If you have a concern about our privacy practices, including the way we have handled your personally identifiable information, you can report it to the data protection authority that is authorized to hear those concerns.

TrueDepth Sensor API Data Collection

Optical measurements collected from the iOS devices using the TrueDepth Sensor API will only be used for the creation of the custom lenses for eyewear products. This data is used internally for the creation of the lenses and not shared with any third party. The data includes pupil distance, segment height and caliber. This data can be deleted on any user request.
